Two DWI’s with Kids in the Car in Westchester

Bronx Man Arrested for DWI with Child Passenger on I-684

On August 2, 2026, at approximately 3:20 a.m., New York State Police in Somers observed a vehicle traveling southbound on Interstate 684 in the Town of North Salem in violation of the New York State Vehicle and Traffic Law.

During the traffic stop, the operator, identified as Jonathan Danilo Burgos Pua, 33, of Bronx, New York, exhibited signs of intoxication. Standardized Field Sobriety Tests were administered, and further investigation revealed that an 11-year-old child was in the vehicle at the time of the incident.

Burgos Pua was taken into custody and transported to State Police Somers for processing, where he submitted to a chemical breath test that yielded a blood alcohol content (BAC) of 0.09%. The child was safely released to a sober third party.

As a result of the investigation, Burgos Pua was charged with:

  • Aggravated Driving While Intoxicated with a Child Passenger (Leandra’s Law), a Class E felony;
  • Driving While Intoxicated with a Blood Alcohol Content of 0.08% or More, an unclassified misdemeanor; and
  • Driving While Intoxicated, an unclassified misdemeanor.

Burgos Pua was issued traffic tickets returnable to North Salem Town Court on August 24, 2026, at 5:30 p.m.

Peekskill Man Arrested for Leandra’s Law DWI

On August 2, 2026, at approximately 2:49 a.m., New York State Police in Cortlandt observed a vehicle traveling northbound on Smith Street in the City of Peekskill in violation of the New York State Vehicle and Traffic Law.

During the investigation, the operator, identified as Manuel V. Carchipulla Lupercio, 52, of Peekskill, New York, exhibited signs of intoxication. Further investigation revealed that a 9-year-old child was in the vehicle at the time.

Carchipulla Lupercio was taken into custody and transported to State Police Cortlandt for processing, where he submitted to a chemical breath test that yielded a blood alcohol content (BAC) of 0.12%. The child was safely released to a sober third party.

As a result of the investigation, Carchipulla Lupercio was charged with Aggravated Driving While Intoxicated with a Child Passenger (Leandra’s Law), a Class E felony; Driving While Intoxicated with a Blood Alcohol Content of 0.08% or More, an unclassified misdemeanor; and Driving While Intoxicated, an unclassified misdemeanor.

Carchipulla Lupercio was arraigned at White Plains City Court and released on his own recognizance. He is scheduled to return to Peekskill City Court on August 6, 2026, at 9:30 a.m.
