Andre Rainey has been taken off the ballot for the New York State Assembly. News 12 reported that challenges to Rainey’s petitions, filed by County Legislator Colin Smith, one of four democrats seeking to replace Assemblywoman Sandy Galef, who is retiring, were deemed credible by the Board of Elections.

More than 250 of Rainey’s signatures were thrown out, based on the democrats who signed also signing another petition, or for errors made in writing their address on the petition.

In Rainey is unable to get on the ballot for the democratic primary, Smith will face off against Dana Levenberg, Supervisor for the Town of Ossining; former Peekskill Mayor Andre Rainey; former Peekskill Council City Council member Vanessa Agudelo. Agudelo is also running on the Working Families Party line, so her name will appear on the ballot in November.

The 95th district is made up of Ossining, Croton on Hudson, Peekskill, the Town of Cortlandt, and parts of Putnam County.
