On Election Day, November 4, 2025, the COVID nursing home orphan families, who tragically lost
family members under Governor Cuomo during the pandemic, announced a $10,000 donation if any New Yorker can prove a single sentence of former governor Andrew Cuomo’s controversial COVID-19 nursing home directive followed the Trump CDC/CMS guidelines.
Whether Andrew Cuomo wins or loses this New York City mayoral race, the nursing home
families will continue to fight for the truth of whether his DOH directive was following the
federal guidelines, as he has testified to Congress.
Since the Cuomo campaign used ChatGTP and AI to create government policies and AI-generated videos; nursing home families also used ChatGTP 5 to ask about Cuomo’s veracity.
We uploaded the CMS/CDC March 4th, 9th, 13th and 23rd guidelines, the CMS 2025 response letter and the DOH March 25th directive and we prompted:
- “Analyze these documents and conclude if Cuomo was following the federal guidelines or not.”
As part of the response that we received from ChatGPT, the following was included:
“Do the NY and federal directives match?
- Federal: Acceptance of COVID-positive residents was conditional — a facility could accept them only if it could follow CDC Transmission-Based Precautions; otherwise admissions should wait.”
It is important to note that this condition was not mentioned in the NY directive.
ChatGPT then concluded:
- “NO. The March 25, 2020 New York directive did not track the federal CDC/CMS
guidance.”
For the record, Daniel Arbeeny filed a class action federal lawsuit that was dismissed on
qualified immunity grounds and not on the merits. The decision was appealed to the Second

to factually prove ONE sentence in his DOH directive that came from the Trump CDC/CMS
