Paulin’s legislation requires insurance coverage for the final stage of breast reconstructive surgery
Assemblymember Amy Paulin announced that Governor Hochul has signed into law legislation she authored (Ch. 228 of 2024) which helps breast cancer survivors by requiring certain insurers to provide coverage for tattooing performed by a physician as part of breast reconstruction surgery.
“By requiring insurance coverage for breast tattooing as part of the reconstruction process for breast cancer survivors, we’re ensuring that women have access to the full spectrum of care they need and deserve,” said Paulin. “This isn’t about cosmetics – it’s about helping survivors feel complete again after a physically and emotionally challenging experience.”
While State law requires insurance companies to provide coverage for reconstructive surgery following a mastectomy or partial mastectomy, the final stage of the reconstruction process, tattooing to create a realistic looking nipple and areola on the breasts, is not currently covered by most insurance companies. Paulin’s new law will now require insurance coverage of breast tattooing following a mastectomy or partial mastectomy. “This coverage should not be considered an elective procedure,” said Paulin. “It is the last and needed step in a breast cancer survivor’s breast reconstructive journey.”
Memorial Sloan Kettering Cancer Center (MSK) in New York performs several hundred medical tattooing procedures each year and has been a strong advocate for the bill. “Nipple reconstruction and tattooing are essential components of breast reconstruction for cancer patients,” said Babak Mehrara, MD, Chief of the Plastic and Reconstruction Service at MSK. “This final step in the reconstruction process not only restores physical form but also plays a crucial role in enhancing the quality of life for survivors. By addressing both the aesthetic and emotional aspects of recovery, these procedures help patients regain a sense of wholeness and confidence after their battle with breast cancer. The bill signed by Governor Hochul marks a significant milestone for breast cancer survivors in New York, ensuring that all patients have access to comprehensive care that fully supports their journey to recovery.”
“Breast Cancer survivors shouldn’t have to struggle to pay for the medical procedures they need for their recovery,” said Paulin. “I’ve always been committed to improving the health outcomes and lives of women, and this bill is an important step in that direction.”
This bill was passed in the New York State Senate by Senator Cordell Cleare.
