Westchester Assistant Commissioner of Health Peter Delucia Resigns After DA Rocah Charges Him With 3 Felonies for Failing to Disclose $95,000 in Income

Defendant allegedly failed to disclose to the Westchester County Board of Ethics more than $95,000 in additional income over a three-year period

On March 20, Westchester County District Attorney Miriam E. Rocah announced that a Westchester County Department of Health Assistant Commissioner was arrested and charged with failing to disclose to the Westchester County Board of Ethics more than $95,000 in income he received from an environmental health consulting firm in 2020, 2021, and 2022.

The defendant, Peter DeLucia, 54, of South Salem, was arrested today by the Westchester County District Attorney’s Office and charged with three felony counts of Offering a False Instrument for Filing in the First Degree. The defendant was issued a Desk Appearance Ticket for a Mar. 27 arraignment in White Plains City Court. 

As alleged in the felony complaint, the defendant failed to disclose a total of more than $95,000 received for consulting services in checks, wire transfers and automatic bank transfers from Retired Regulators LLC, DBA Rapid Response Environmental Health Consulting LLC, on his 2020, 2021, and 2022 forms.  

As mandated by Westchester County, certain employees, including the defendant, are required to file Annual Statements of Financial Disclosure with the Westchester County Board of Ethics disclosing the source and nature of any income in excess of $1,000 related to any outside occupation, employment, business or profession while employed by the County. 

The defendant allegedly received and deposited approximately $14,000 in 2020, $36,000 in 2021, and $45,000 in 2022. 

The DA’s Office learned of the allegations in October 2023 and launched an investigation.  

The case is being prosecuted by Senior Assistant District Attorney Renee Hassel of the Public Integrity and Law Enforcement Integrity Bureau in the Trials and Investigations Division.

The charges against the defendant are merely accusations, and the defendant is presumed innocent unless and until proven guilty.  

DeLucia has served for 30 years in the Westchester Department of Health, when he became an assistant commissioner in 1993 under County Executive Andrew O’Rourke, DeLucia has served under four County Executives.

According to Westchester County spokeswoman Catherine Cioffi DeLucia was placed on leave and has submitted his resignation, effective March 25.
