Yonkers Police Arrest, Charge former YPS Employee for Public Lewdness

Members of the Yonkers Police Department were notified by the Yonkers Public Schools administration of a complaint of inappropriate conduct involving an employee of the Yonkers Public Schools system. The Yonkers Police Intelligence Unit initiated a criminal investigation.

Investigation yielded that on Tuesday, February 28th, 2023, at approximately 11 AM, the subject of the investigation allegedly exposed his intimate parts in a lewd manner to a 58-year-old female. The incident occurred in a rented private office located in the Yonkers PAL at 127 North Broadway. No other people were present in the office nor was the incident visible outside the office.

Arrested earlier today was Rafael PENA, a 57-year-old resident of Yonkers. PENA was a Program Specialist for the Yonkers Public Schools; he was separated from employment on February 28th. PENA began working for the district in 2014. PENA is being charged with one count of Public Lewdness, a Class B Misdemeanor in the New York State Penal Law. The case is being prosecuted by the Westchester County District Attorney’s Office.
