
On June 28, 2026, at approximately 2:45 a.m., New York State Police in Cortlandt observed a vehicle traveling southbound on Route 9 in the Town of Cortlandt in violation of the New York State Vehicle and Traffic Law.
While interviewing the operator, identified as Artemio Martinez Gonzalez, 34, of Yonkers, displayed signs of intoxication. Standardized Field Sobriety Tests were administered. Further investigation revealed that a 2-year-old child was in vehicle at the time.
Martinez Gonzalez was subsequently placed under arrest and transported to State Police Cortlandt for processing, where he submitted to a chemical breath test that yielded a blood alcohol content (BAC) of 0.14%. The child was safely released to a sober third party.
As a result of the investigation, Martinez Gonzalez was charged with Aggravated Driving While Intoxicated with a Child Passenger (Leandra’s Law), a Class E felony; Driving While Intoxicated with a Blood Alcohol Content of 0.08% or More, an unclassified misdemeanor; and Driving While Intoxicated, an unclassified misdemeanor.
Martinez Gonzalez was arraigned in the Town of Cortlandt Court and released on his own recognizance
