Rape Arrest at Yorktown Nursing Home Has Families Outraged

On Feb. 25, the Yorktown Police Department reported the arrest of 48-year-old Javier Barragan of Shrub Oak, who is charged with Rape 2nd Degree, a Class D Felony, and Endangering Welfare of an Incompetent Person 2nd Degree, a Class A Misdemeanor.

On February 21, 2026, at approximately 7:08 AM, the Yorktown Police Department responded to The Yorktown Rehabilitation and Nursing Center, located at 2300 Catherine St, Yorktown, for the report of an alleged sexual assault. Upon arrival, a comprehensive investigation was conducted. It was determined that the defendant, who was an employee at the facility, allegedly engaged in sexual intercourse with the victim, who is a resident of the facility. It was determined that the victim is incapacitated and lacks the ability to consent.

The defendant surrendered himself at Yorktown Police headquarters and was placed under arrest. After arrest processing was completed, the defendant was arraigned by the Honorable Judge Raniolo at the Yorktown Justice Court. A temporary order of protection was served on the defendant, protecting the victim, and bail was set at $100,000 cash. After failing to post bail, the defendant was remanded to the Westchester County Jail and turned over to the Westchester County Department of Corrections.

Barragan’s next court date in Yorktown Justice Court is on March 10.

Family members who have loved ones at Yorktown Rehabilitation and Nursing Center have a lot of questions, including the following posts:

“A CNA heard a loud noise and went in the room and found the worker on top of the patient.
The employee was there for 20 something years!! Employee of the month multiple times!!! Insane”

“What I find upsetting my mother in law is a resident at this facility …. And we were NOT notified of this incident . I feel it’s the job of the director of the facility to notify all the families of this disgusting disturbing act that took place.”

“The Human Resources department said “it does not wish to give more information.” Really???”

Under New York law, second-degree rape – defined as sexual intercourse with a person who is incapable of consent by reason of being mentally disabled or mentally incapacitated – is a Class D violent felony punishable by up to seven years in a maximum-security state prison. The Westchester County District Attorney’s Office has filed charges, but not before our deadline.

Civil litigation by the victim’s family is widely expected.

The New York State Department of Health may conduct its own investigation of the facility, which could result in additional defi ciency citations, fi nes, or enforcement actions.

NursingHomeNews.org reported that, “The facility was not always a corporate-owned, for-profit operation. For more than 130 years, it operated as Field Home–Holy Comforter, a non-profit institution with a long tradition of serving the elderly in the Hudson Valley. That changed in April 2018, when the nonprofit Fieldhome organization sold the campus to Personal Healthcare LLC for approximately $28 million, as reported by Westfair Online. Under new ownership, the bed count was expanded from 127
to 200.

The facility was designated a Special Focus Facility (SFF) candidate by CMS on October 25, 2023, a designation reserved for nursing homes with persistent quality problems. Only approximately 400 facilities nationally receive this designation at any given time, placing Yorktown among the worst-performing homes in New York State at the time.

Several families want to make sure that their loved ones at the home were not abused by Barragan, and want a photo ID.
