White Plains Man Gets 8 Years in Prison for Enganging in Sexual Conduct with Two Children

Westchester County District Attorney Miriam E. Rocah announced that a White Plains man was sentenced on May 9, 2023, to eight years in state prison, with 15 years of post-release supervision, for engaging in sexual conduct with two children. The defendant is required to register as a sex offender.  

DA Rocah said: “This defendant preyed upon the innocence of two vulnerable children who trusted him. This outcome is justice for the young survivors who exhibited great courage and bravery coming forward.”

On September 2, 2022, David Rivera, 35, pleaded guilty to two counts of Course of Sexual Conduct Against a Child in the First Degree, a felony, for subjecting two child victims to repeated acts of sexual conduct. For one victim the criminal conduct started in 2010, when the child victim was five-years-old and continued into 2013. For the second victim, the criminal conduct started in 2006, when the child victim was 11-years-old and continued into 2007.  

White Plains Public Safety arrested the defendant on February 8, 2021, following an investigation.  

In a statement to the court, the youngest victim said: “You have denied it so many times but this is the reality of your actions. And I’m happy that I’m getting the justice that I deserve.” 

The case was before Judge Susan Cacace in Westchester County Court, and was prosecuted by Child Abuse/Elder Abuse Bureau Chief Christine Hatfield and Assistant District Attorney Mollie O’Rourke, both of the Special Prosecutions Division.
