On Dec. 16, Westchester County District Attorney Miriam E. Rocah announced that Yorktown resident Eric DiBartolo and Cortlandt Manor resident Tyrone Bass were sentenced for stealing nearly $15,000 worth of merchandise from The Home Depot in 20
On Dec. 16, 2021, DiBartolo, 60, pled guilty to Petit Larceny, and Bass, 59, pled guilty to Criminal Possession of Stolen Property in the Fifth Degree, both misdemeanors. Each defendant was sentenced to a one-year conditional discharge, 50 hours of community service, and are barred from entering all Home Depot locations.
DiBartolo also paid full restitution for the items stolen from the Mohegan Lake Home Depot store.
“Eric DiBartolo hatched this organized and ongoing scheme to steal thousands of dollars of merchandise,” DA Rocah said. “He and his accomplice will now be held accountable in a manner consistent with other perpetrators of similar theft operations.”
On over 20 occasions between Aug. 2020 and Dec. 2020, DiBartolo acted with Bass, a cashier at the store, to steal $14,469 worth of building supplies, tools and other merchandise from The Home Depot in Mohegan Lake. During each visit, DiBartolo brought his merchandise to Bass, who only scanned a portion of the items and placed the remaining, unpaid merchandise into shopping bags. On each occasion, DiBartolo exited the store only paying for a few of the many items he left with.
Following an investigation, the Westchester County Department of Public Safety arrested Bass on Dec. 16, 2020 and DiBartolo on Jan. 6, 2021. The case was before Judge Maritza Fugaro-Norton in Cortlandt Town Court, and was prosecuted by Assistant District Attorney Livia Rodriguez.
DA Rocah’s comment above, that DiBartolo was sentenced “consisten with other perpetrators of similar theft operations, is an indication that DiBartolo got the same sentence as anyone else charged with a similar crime. But we looked back at what DiBartolo was originally charged with, it was Felony Grand Larceny.
The Felony charge was eventually reduced to the charge that he pled to–Petty Larceny, a misdemeanor. Based on the outrage from the Yorktown community over what they perceive as “a slap on the wrist” as one homeowner -resident-taxpayer told us we will be speaking with criminal defense attorneys in Westchester to determine if the sentence given to DiBartolo was within reason.
The other part of this story are the number of other intolerable acts that we have heard about DiBartolo. Unfortunately, those acts can not be included in the determination of his sentencing for the Home Depot thefts because DiBartolo was not charged with any crimes related to the anti-semitism that he was accused of in a Civil Lawsuit filed by a jewish employee of the Town of Yorktown, or when he pulled over a female in a police car when he was not, or never was a member of the Yorktown PD.
Some in Yorktown are still looking at this case, and DiBartolo’s history, to see what if anything can be done. More on this story coming.
